These Terms and Conditions ("Terms") govern your access to and use of Tundla.com — a local business discovery platform for Tundla city, Firozabad district, Uttar Pradesh, India, operated by Tundla.com ("we", "us", or "our"). By accessing or using our website at tundla.com, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must immediately stop using Tundla.com.

1. Eligibility

You must be at least 18 years of age to use Tundla.com. By using our platform, you represent and warrant that you meet this age requirement and that you have the legal authority to agree to these Terms.

2. User Accounts

  • Accounts may be created via Google Sign-In. You are responsible for all activity under your account.
  • You must provide accurate, complete, and current information. Misrepresentation may result in immediate account suspension.
  • You are responsible for maintaining the confidentiality of your Google account credentials.
  • You must notify us immediately at support@tundla.com of any unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Business Listings

3.1 Eligibility to List

Business listings are open to any legitimate business operating in or serving Tundla city and surrounding areas. Listing your business on Tundla.com is free of charge.

3.2 Accuracy of Information

You, as the business owner or authorised representative, are solely responsible for:

  • The accuracy and legality of all information submitted
  • Keeping your business details (address, phone, hours) up to date
  • The content and quality of photos and media uploaded

3.3 Approval and Moderation

All new business submissions are reviewed by our team before going live. We reserve the right to:

  • Approve or reject any listing at our sole discretion
  • Remove listings that violate these Terms or contain false information
  • Edit listing information for clarity or accuracy

3.4 Prohibited Content

Business listings must NOT include:

  • False, misleading, or fraudulent business information
  • Illegal businesses or services prohibited under Indian law
  • Inappropriate, adult, or offensive content
  • Content that infringes third-party intellectual property rights
  • Contact details belonging to a competitor
  • Multiple duplicate listings for the same business

4. User Reviews and Ratings

  • Reviews must be based on genuine, first-hand experience with the business.
  • Reviews must be factually accurate, respectful, and not defamatory.
  • The following are strictly prohibited: fake reviews, reviews submitted in exchange for payment or incentives, competitor-targeted negative reviews, and reviews containing personal attacks or abusive language.
  • We reserve the right to remove any review that violates these guidelines without prior notice.
  • Business owners may not post reviews for their own business or competitors' businesses.
  • Submission of fraudulent reviews may result in account suspension and potential legal action under the IT Act 2000.

5. User-Generated Content

By submitting any content to Tundla.com (including business descriptions, photos, reviews, or FAQs), you:

  • Grant Tundla.com a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content on our platform and in promotional materials.
  • Confirm that you own the content or have the necessary rights to submit it.
  • Confirm the content does not violate any third-party rights or applicable law.

You retain ownership of content you submit. We do not claim ownership of your content.

6. Acceptable Use

You agree not to:

  • Scrape, crawl, or systematically extract data from Tundla.com without our written permission
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Use the platform to send spam or unsolicited communications to businesses
  • Interfere with or disrupt the integrity or performance of the platform
  • Upload malware, viruses, or malicious code of any kind
  • Use automated systems to submit listings, reviews, or any other content
  • Use Tundla.com for any unlawful purpose prohibited under Indian law

7. Intellectual Property

All content on Tundla.com that is not user-generated — including the Tundla.com name, logo, website design, software, and original text — is the exclusive intellectual property of Tundla.com and is protected under applicable copyright and trademark laws of India.

You may not reproduce, distribute, or create derivative works of our proprietary content without express written permission.

8. Third-Party Services

Tundla.com integrates the following third-party services:

  • Google Sign-In — for authentication
  • Google Maps & Places API — for address autocomplete and map display
  • Google Analytics & Tag Manager — for usage analytics

Your use of these services is subject to Google's Terms of Service and Privacy Policy. We are not responsible for the practices of these third-party services.

9. Disclaimer of Warranties

Tundla.com is provided on an "as is" and "as available" basis without warranties of any kind. We do not warrant that:

  • Business information listed is accurate, complete, or current (it is provided by the business owners)
  • The platform will be available uninterrupted or error-free
  • Any particular business on our directory is legitimate, licensed, or of any particular quality

Users are advised to independently verify business details, particularly for medical, legal, or financial services.

10. Limitation of Liability

To the maximum extent permitted by Indian law, Tundla.com and its operators shall not be liable for:

  • Any loss or damage arising from inaccurate business information
  • Transactions or agreements entered into with businesses listed on our platform
  • Any indirect, incidental, consequential, or punitive damages
  • Loss of data or revenue resulting from use of the platform

Our total aggregate liability to you shall not exceed ₹1,000 (Indian Rupees One Thousand).

11. Termination

We may suspend or terminate your access to Tundla.com at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent activity
  • Conduct harmful to other users, businesses, or third parties
  • Any other reason at our sole discretion

Upon termination, all provisions of these Terms that by their nature should survive will continue to apply (including intellectual property, disclaimer, and liability clauses).

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, specifically the:

  • Information Technology Act, 2000 (and amendments)
  • Digital Personal Data Protection Act, 2023
  • Indian Contract Act, 1872
  • Consumer Protection Act, 2019

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Firozabad, Uttar Pradesh, India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. The "Last updated" date at the top of this page will reflect the latest revision. Continued use of Tundla.com after any changes constitutes acceptance of the updated Terms.
